Application for the Review of a Premises Licence under the Licensing Act 2003

To consider an application for the review of a Premises Licence

Minutes:

The Licensing Sub-Committee was held to review the Premises Licence as requested by the applicant, on the grounds that the following Licensing Objectives under the Licensing Act 2003 (the ‘Act’) are not being effectively promoted:

i) Prevention of Crime and Disorder; and

ii) ii) The Protection of Children from Harm.

The Licensing Officer presented the report, which set out details of the events.

The Sub-Committee heard from the applicant who, by way of background, advised of a national crackdown on underage selling launched in October 2021 and WSCC Trading Standard’s Zero Tolerance policy launched in January 2022. He outlined the events that had occurred and evidence of the sale of age-restricted products to children.

The Premises Licence holder attended the sub-committee, with a representative. The representative spoke in support of the continuation of the current premises licence, on behalf on the Premises Licence holder. Additionally, he put forward that if the committee chose to suspend the licence that a level three accredited Designated Licence Supervisor could be put in place at the business and the current Designated Licence Supervisor be removed.

The Members of the Sub-Committee considered the statements and responses from the Premises Licence holder and the applicant, and all the evidence presented in the appendices to the report together with footage from the premises CCTV.

The Licensing Sub-Committee considered their decision under the following licence objectives, as required under the Licensing Act 2003:

· Prevention of Crime and Disorder

· Protection of Children from Harm

RESOLVED

i) That the Premises Licence be suspended for three months, the current Designated Premises Supervisor be removed and replaced with a new Designated Premises Supervisor with a level three training accreditation.

ii) That the Premises Licence current conditions be amended in respect of the CCTV requirements under the heading of Prevention of Crime and Disorder and an amendment to the condition under the heading of Protection of Children from harm.

The Premises Licence Holder has 21 days from receipt of the decision on the 21st of December in which to appeal.
